Custody and Visitation
The family law team at Meriwether & Tharp LLC encourages the parties to work together towards a mutually agreeable custody and visitation schedule that provides liberal visitation in the best interest of the children. If the parties are at a point of disagreement, rather than rushing to the judge, we often involve experienced mediators to assist the parties with working towards an agreement that is both a win for each parent and most importantly, a win for the children who are caught in the middle of the dispute. Disputes over custody and visitation can often be the most expensive part of a divorce because emotions tend to drive the parties to the Court, often driving up legal expenses.
In cases where the parties are disputing custody, frequently a Guardian ad Litem (typically an attorney) is appointed by the judge to represent the interests of the children in the action. A Guardian will give a recommendation to the court as to what would be in the “best interest of the children” in regards to a custody and visitation arrangement. In certain situations, a custody evaluator can be appointed to develop an expert opinion as to which parent would be the best primary custodian for the children.
