Timing of a Divorce
The question of "How long will this divorce take?" is probably one of the most frequently asked questions. The short answer is that it depends upon the willingness of both parties to sit down and negotiate a settlement in their case. It takes two parties to settle the divorce and to have it move as expeditiously and economically as possible. It only takes one person to drive up the costs and length of time it takes to get a divorce. There are other factors involved, of course and those include the schedule of the court and the cases that are ahead of yours and a variety of factors too numerous to list here.
Generally speaking, if both parties come to an agreement on all issues in the divorce, a court can hear a case thirty-one (31) days after the person has either been served with the Complaint or acknowledged service of the Complaint. There are current efforts in the Georgia legislature today, however, to extend the waiting period to six months.
